General Terms and Conditions

Please read this agreement with due care and attention before accessing or using the information and services available through the Jobtag website ("Site"). By accessing or using the Site, you agree to be bound by the terms and conditions below. Jobtag may amend this agreement at any time, and such amendments shall be effective immediately upon posting the amended agreement on the Site. Terms and conditions for Advertisers must be accepted and adhered to by Advertisers who use Jobtag's services and the Site. Jobtag also has a comprehensive privacy policy for users of the Site.

The following terms and conditions apply to all Job Seekers, Employers, Publishers and other users (“Users”) who access or use the Site, or otherwise indicate their acceptance to this agreement.

Copyright and trademarks

Copyright in the material and trademarks on this Site are owned by Jobtag Pty Ltd ABN 61 608 317 399 (“Jobtag”) unless otherwise indicated and you agree not to infringe any intellectual property rights owned by Jobtag.

Information for non-commercial, personal use only

Users of the Site agree that information contained on this Site is for personal use only and may not be sold, redistributed or used for any commercial purpose (including but not limited to the use of Advertiser contact details for unsolicited commercial correspondence). It is permissible that Users download material from this Site for personal, non-commercial use only, provided all copyright and other proprietary notices are kept intact.

Under no circumstances can information or material from the Site (including code and software) be copied, republished, modified, reproduced, posted, uploaded, transmitted or distributed in any way, including without limitation for the purposes of establishing, maintaining, advancing or reproducing information contained of this Site on your own website or in any other publication. Users must not use this Site for any purpose that is unlawful or prohibited by these terms of use. Users must not use any form of data mining, data gathering, extraction or publication tools on this Site.

No guarantees of job vacancy

Jobtag gives no guarantee of the continued availability of any particular job advertised on the Site and will not be liable to any User should an advertiser have filled the vacancy at any time prior to removal of the advertisement from the Site.

Whilst Jobtag recommends to Advertisers that ALL jobs advertised are for actual job vacancies, Jobtag is unable to ensure that this is the case. Jobtag gives no guarantee that every job advertisement represents an actual job vacancy.

Website links

Website links and pointers to Internet sites maintained by third parties are provided by Jobtag, including links to Advertisers websites. Such linked sites are not under the control of Jobtag and Jobtag can take no responsibility for the contents (including the accuracy, legality or decency) of any linked site or any link contained in a linked site. These links are provided to the User only as a convenience, and the inclusion of any link does not imply endorsement or guarantee by Jobtag of the linked site. Jobtag is not responsible for the copyright compliance of any linked site. Jobtag will not be liable for any loss or damages arising in any way out of or in connection with or incidental to any information or third party service provided by any third party.

Professional advice

By accepting these terms of business, Users acknowledge and agree that any information published by Jobtag is intended to provide general information in summary form on legal, financial and other issues.

Jobtag does not endorse or recommend any of the jobs, business or self-employment opportunities advertised on its Site. Jobtag recommends that prior to entering into any agreement with any of the Advertisers on the Site, that the User obtains their own independent legal, accounting, financial or taxation advice as appropriate. It is solely the responsibility of the User to evaluate the accuracy of all opinions, advice, services and other information provided through the Site.

In no event will Jobtag be liable to the User or anyone else for any decision made or action in reliance upon any information contained or omitted from the Site.

Service information

Whilst every effort is taken to provide an uninterrupted and error free service, Jobtag provides no warranty to the User that the services generally available through the Site will be uninterrupted or error free or that defects in the service will be corrected. Jobtag does not guarantee or warrant to you that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. It is the sole responsibility of the User to implement sufficient procedures and processes to satisfy any specific requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

Security of your information

Jobtag will take all due care in ensuring the privacy and integrity of the information you provide, however the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on Jobtag’s Site or Jobtag’s server. Jobtag disclaims all liability to you to the greatest extent possible pursuant to law should this occur.

Password and login information

To become a registered User, you must provide a password and a login name, and it is the Users responsibility to maintain the confidentiality of this password and login name. Furthermore, the User is solely and entirely responsible for any and all activities that occur under their login name. The Users password can be changed at any time by following instructions. You may also change your login by contacting customer service. You may also delete services attached to your registration at your convenience.

You agree to notify Jobtag immediately should any unauthorized use of your login name or any other breach of security known to you occur.

No misrepresentations allowed

You agree that it is a condition on your use of the Jobtag Site and of any other services provided by Jobtag or through the Site that you will not through any act or omission (including but not limited to creating a profile on the Jobtag Site) mislead or deceive others.

Users Obligation

Users of the Site warrant and agree that:

a) you have the legal capacity and power to agree to be bound by the Terms and perform the obligations under them;

b) all files delivered to Jobtag will be free of infection or viruses;

c) advertisements, video profiles and other works posted on the Site do not breach the intellectual property rights of any third party;

d) you will not use the Site for any illegal purpose;

e) you will not use the Site or any features of the Site or products offered on the Site to upload, download, transact, store or make available data that is unlawful, harassing threatening, harmful, tortious, defamatory, libelous, abusive violent, obscene, invasive of another's privacy, racially or ethnically offensive or otherwise in our opinion objectionable or damaging to Jobtag, the Site users or persons generally;

Users indemnify and will keep indemnified Jobtag, its officers, employees and agents against all claims, actions, suits, liabilities, actual or contingent costs, damages and expenses incurred by Jobtag in connection with:

a) any breach of these Terms by you;

b) any negligent act or omission by you;

c) the listing or proposed listing of any advertisement or video profile by you on the Site or any related site; or

d) an actual or alleged breach by you of any law, legislation, regulations, by-laws, ordinances or codes of conduct which occurs as a consequence of your advertisement or video profile appearing on the Site.

You agree at all times to deal with any information or products provided by Jobtag or accessed from the Site in a manner which abides by all applicable laws of Australia, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).

General provisions

If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.

Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.

The laws governing this agreement will be the laws in New South Wales, Australia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Australia sitting in New South Wales.

For the purposes of this agreement the words "Jobtag", "Jobtag Pty Ltd", "We", "Our" and "Us" refer to Jobtag Pty Ltd and "Site" to materials delivered on and other co-branded versions of the site.
